Terms & Conditions

Last updated: 2 September 2026

1. About these Terms

These Terms & Conditions ("Terms") apply to your use of the Mia Creates website at www.miacreates.com.au and to purchases made through the website or from Mia Creates in person. By using our website or placing an order, you agree to these Terms.

Mia Creates can be contacted at hello@miacreates.com.au.

2. Use of Our Website

You may use our website for lawful purposes and in accordance with these Terms. You must not use the website in a way that is unlawful, fraudulent, abusive, harmful to our systems or services, or that interferes with another person's use of the website.

You must not attempt to gain unauthorised access to our website, accounts, systems or data, introduce malicious code, scrape or copy website content in an unauthorised manner, or use the website to distribute material that is unlawful or harmful.

3. Customer Accounts

Some features of our website may require you to create an account. You are responsible for providing accurate information and keeping your login credentials secure.

You should notify us if you believe your account has been accessed without your permission. We may suspend or restrict an account where reasonably necessary to protect our website, customers or business, or where an account is being used unlawfully or in breach of these Terms.

4. Products

We make and sell 3D-printed toys, gadgets, fidgets and related products. We aim to ensure that product descriptions, photographs, colours, dimensions and other information on our website are accurate. However, minor variations may occur due to screen settings, materials, lighting, 3D-printing processes and normal manufacturing variation.

Because our products are 3D-printed, individual items may have minor variations in layer lines, surface finish, colour, texture or appearance. These variations do not necessarily indicate a defect.

Nothing in these Terms limits your rights under the Australian Consumer Law where a product does not meet the applicable consumer guarantees.

5. Product Safety and Use

Some Mia Creates products are designed as toys, fidget items or decorative/desk items. Please read and follow any age recommendations, warnings and care instructions provided with the product.

Products may contain small parts or components that may become detached if a product is damaged or subjected to excessive force. Products should not be deliberately bent, twisted, pulled apart, crushed, thrown, chewed, stood or sat on, or used in a way that is inconsistent with their intended purpose.

If a product becomes cracked, broken or develops loose or detached parts, discontinue use and keep the product away from children until it has been assessed or safely disposed of.

These statements are intended to provide reasonable care and use information and do not exclude or limit any rights or remedies available under the Australian Consumer Law.

6. Orders

When you place an order, you are making an offer to purchase the selected products. We may accept or decline an order for reasonable reasons, including product availability, an error in product or pricing information, suspected fraud or an inability to process payment.

An order is generally accepted when we confirm the order and payment has been successfully processed. We will contact you if we need to cancel or change an order.

If we cannot supply a product you have paid for, we will provide an appropriate remedy in accordance with applicable law.

7. Personalised and Custom Products

Some products can be personalised or custom-made using information supplied by the customer.

You are responsible for checking the spelling, names, numbers, colours, designs and other details you submit before placing your order. We will generally produce the item according to the information supplied.

Personalised and custom-made products may not be eligible for change-of-mind returns because they have been specifically made for you. This does not affect your rights under the Australian Consumer Law if the product is faulty, not as described or otherwise does not meet the applicable consumer guarantees.

You must not submit personal information, images, text or other material for personalisation unless you have the right to provide and use that material.

8. Prices and Payment

Prices are displayed in Australian dollars unless stated otherwise. Prices may change from time to time, but changes will not affect an order that we have already accepted except where required or permitted by law.

We use Square and other payment functionality made available through our website to process payments. Payment information is processed by the relevant payment provider.

If a genuine pricing or product-description error occurs, we may contact you to discuss the error. If an order is cancelled because of such an error, any amount already paid for the cancelled order will be refunded.

9. Shipping and Delivery

We will deliver products to the delivery address provided with your order. You are responsible for ensuring that the delivery details you provide are accurate and complete.

Delivery timeframes displayed on the website or provided by us are estimates unless we have specifically agreed otherwise. Delays may occur due to circumstances outside our reasonable control.

If an order is delayed, lost or damaged during delivery, please contact us so that we can investigate and assist. Nothing in these Terms limits your rights under the Australian Consumer Law.

10. Returns, Refunds and Exchanges

Our Refund & Returns Policy forms part of these Terms and explains our change-of-mind return process, personalised-product returns, damaged or faulty products and refunds.

Our Refund & Returns Policy is available on the Mia Creates website.

Nothing in our Refund & Returns Policy or these Terms excludes, restricts or modifies rights you have under the Australian Consumer Law.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

12. Intellectual Property

Unless otherwise stated, the Mia Creates name, logo, website content, product photographs, graphics, written content, designs and other materials made available by Mia Creates are owned by or licensed to Mia Creates and are protected by applicable intellectual property laws.

You may view and use our website for personal and lawful purposes. You must not reproduce, modify, distribute, sell, commercially exploit or otherwise use our website content, product designs, photographs or branding without our written permission, except where permitted by law.

Purchasing a physical 3D-printed product does not transfer ownership of the underlying design or intellectual property in that design.

13. Customer Content

If you submit photographs, reviews, comments, text, designs or other material to Mia Creates, you confirm that you have the right to provide that material and that its use by us as reasonably necessary to provide our products or services will not infringe another person's rights.

You should not submit unlawful, defamatory, threatening, abusive or infringing material.

We may remove or decline to publish customer content that we reasonably consider inappropriate or that breaches these Terms or applicable law.

14. Third-Party Services and Links

Our website may use or link to third-party services, including Square, Google, Firebase, payment services and delivery services.

Third-party services are governed by their own terms and privacy policies. We are not responsible for the content, availability or practices of third-party websites or services.

15. Privacy

Our Privacy Policy explains how we collect, use, store and disclose personal information. Your personal information will be handled in accordance with our Privacy Policy.

Our Privacy Policy is available on the Mia Creates website.

16. Website Availability and Errors

We aim to keep our website accurate, secure and available, but we do not guarantee that the website will always be available, uninterrupted, error-free or free from viruses or other harmful components.

We may update, suspend or discontinue parts of the website where reasonably necessary, including for maintenance, security, technical changes or business reasons.

17. Liability

To the maximum extent permitted by law, Mia Creates is not responsible for loss caused by your use of the website or products where that loss is not caused by our breach of these Terms, negligence, unlawful conduct or failure to comply with a consumer guarantee.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including rights and remedies available under the Australian Consumer Law.

18. Indemnity

To the extent permitted by law, you agree to be responsible for losses or reasonable costs Mia Creates suffers as a direct result of your unlawful use of the website, your breach of these Terms, or your infringement of another person's rights.

This clause does not apply to the extent that the loss was caused by Mia Creates' own breach, negligence or unlawful conduct, and does not limit any rights you have under the Australian Consumer Law.

19. Suspension and Termination

We may suspend or restrict access to the website or a customer account where reasonably necessary for security, fraud prevention, unlawful activity, serious misuse or a material breach of these Terms.

Termination or suspension does not affect rights or obligations that arose before termination or that are intended to continue after termination.

20. Changes to these Terms

We may update these Terms from time to time. The updated version will be published on our website and the "Last updated" date will be changed.

Changes will generally apply from the date they are published and will not retrospectively change rights or obligations that have already arisen, except where required or permitted by law.

21. Governing Law

These Terms are governed by the laws of Queensland, Australia, and the applicable laws of the Commonwealth of Australia.

You and Mia Creates submit to the courts of Queensland and courts entitled to hear appeals from them, subject to any rights you may have under applicable consumer protection laws.
